These terms and conditions (“Agreement”) govern the purchase and use of hydraulic components from Prime Hydraulics & Pneumatics Pvt. Ltd. (“Seller”) by the customer (“Buyer”). By placing an order with Seller, Buyer agrees to be bound by the terms and conditions stated herein.

1. Product Specifications:
   1.1 Seller shall provide hydraulic components as specified in the product descriptions, catalogue, or quotation.
   1.2 Buyer acknowledges that it is responsible for ensuring the compatibility of the purchased components with its intended application.
2. Installation and Use:
   2.1 Installation of the hydraulic components shall be the sole responsibility of the Buyer. It is recommended that a qualified professional performs the installation.
   2.2 Buyer agrees to adhere to all relevant industry standards, guidelines, and safety regulations during installation and use of the components.
   2.3 Seller shall not be liable for any damages or losses arising from improper installation, maintenance, or use of the components.
3. Contamination Prevention:
   3.1 Buyer acknowledges that maintaining the cleanliness and integrity of the hydraulic oil is crucial for optimal component performance.
   3.2 Buyer agrees to implement suitable measures, such as filtration systems and regular oil analysis, to prevent contamination of the hydraulic oil.
   3.3 Seller shall not be responsible for any damages or malfunctions resulting from contaminated hydraulic oil.
4. Temperature Control:
   4.1 Buyer acknowledges the importance of maintaining the hydraulic oil at optimal operating temperature for efficient component performance.
   4.2 Buyer agrees to implement appropriate temperature control measures, such as cooling or heating systems, to ensure the oil temperature remains within the recommended range.
   4.3 Seller shall not be liable for any damages or performance issues arising from improper temperature control.
5. Warranty:
   5.1 Seller provides a warranty for the hydraulic components in accordance with the specific warranty terms and conditions stated separately.
   5.2 Warranty claims shall be subject to the terms and conditions outlined in the warranty policy provided by Seller.
6. Limitation of Liability:
   6.1 To the extent permitted by law, Seller shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use or inability to use the hydraulic components.
   6.2 Seller’s liability shall be limited to the purchase price of the components.
7. Intellectual Property:
   7.1 Buyer acknowledges that any intellectual property rights associated with the hydraulic components, including patents, trademarks, copyrights, and trade secrets, are the exclusive property of Seller.
   7.2 Buyer shall not reproduce, modify, distribute, or use any intellectual property rights of Seller without prior written consent.
8. Governing Law and Jurisdiction:
   8.1 This Agreement shall be governed by and construed in accordance with the laws of India. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts in Punjab.
9. Delivery and Title:
   9.1 The Seller will make reasonable efforts to deliver the Products within the agreed timeframe. However, delivery dates are estimates and not guaranteed.
   9.2 Risk of loss or damage to the Products passes to the Buyer upon delivery.
   9.3 Title to the Products shall pass to the Buyer upon receipt of full payment by the Seller.
10. Entire Agreement:
    10.1 This Agreement constitutes the entire understanding between Seller and Buyer regarding the purchase of hydraulic components and supersedes any prior agreements or understandings, whether written or oral.

By purchasing hydraulic components from Seller, Buyer acknowledges and agrees to abide by these terms and conditions.
